These Terms of Use (the "Terms") constitute a binding legal agreement between Crypto-Bond AG, a public limited company governed by Swiss substantive law, with its registered office at Chamerstrasse 172, 6300 Zug, Switzerland, registered with the Commercial Register under number CH-170.3.042.722-8 (Business ID: CHE-209.086.670), and any individual or legal entity accessing, browsing or using the features of the websites and digital platforms published by the operator.
This document exclusively defines the legal framework, access terms, rights, restrictions, liabilities and mutual obligations of the parties in connection with the institutional information website at cryptobond.ch and the secure interactive portal for financial and crypto-asset management at wallet.cryptobond.ch.
Accessing, browsing, or interacting in any way with any of Crypto-Bond AG's digital services constitutes express, prior, full, irrevocable and unconditional acceptance by the User of all the provisions, terms and warnings contained in these Terms.
All IT services, software infrastructure, user interfaces, interactive portals and informational content associated with cryptobond.ch and wallet.cryptobond.ch are designed, published, operated and administered exclusively by the Swiss company Crypto-Bond AG, registered with the Commercial Register of the Canton of Zug under federal number CH-170.3.042.722-8 and holder of Business Identification Number (UID) CHE-209.086.670.

The institutional showcase platform at cryptobond.ch is the company's public information portal. It includes a general presentation of financing structures, indicative (non-contractual) statistical and algorithmic simulators, loan modelling tools, direct contact forms, and documentation on the company's financial ecosystem.
The secure application portal at wallet.cryptobond.ch is the restricted interactive client area. This environment allows duly registered and authenticated users to deposit, lock and monitor crypto-asset collateral, view the Loan-to-Value (LTV) ratio in real time, review their loan history, and interact with dedicated smart contracts.
Crypto-Bond AG reserves the sovereign right to evolve, modify, add or remove any feature or technological component within its web platforms, at any time and without individual notice.
Access to Crypto-Bond AG's Services and platforms is strictly restricted to adult individuals with full legal capacity, at least 18 years of age (or the legal age of majority applicable in their country of residence), as well as to duly registered legal entities represented by legal representatives with the necessary authority.
It is the User's sole and exclusive responsibility to personally verify whether the law of their country of tax residence or access permits use of Crypto-Bond AG's Services.
Access to the advanced, operational and financial features of wallet.cryptobond.ch requires the prior creation of a personal, individual User Account. The User solemnly undertakes to provide accurate, complete, truthful and up-to-date information from account opening onward.
The User bears full, absolute and exclusive responsibility for the confidentiality of their login credentials, passwords and access tokens. The User is formally required to activate the two-factor authentication (2FA) recommended by the platform. Any action, transaction or asset modification carried out using a User's valid credentials shall be irrefutably deemed to have been performed directly by that User.
In the event of loss, theft, compromise of the security of their credentials, or unauthorised access to their client area, the User must immediately notify Crypto-Bond AG by email.
As a Swiss operator of application services related to loans secured by digital assets, Crypto-Bond AG rigorously applies the prevention principles arising from the Swiss Federal Act on Combating Money Laundering and Terrorist Financing in the Financial Sector (AMLA).
To access collateral deposit, credit request or asset withdrawal services, the User is unconditionally subject to a prior and ongoing customer identification procedure (Know Your Customer — KYC), which includes submitting valid official supporting documents (a copy of passport or ID card, a recent proof of address less than three months old, biometric verification photograph).
Crypto-Bond AG reserves the discretionary right to request additional information or documents at any time, to conduct enhanced due diligence, to temporarily freeze operations, or to refuse to open or continue a business relationship with any User who does not fully satisfy AMLA compliance requirements.
The financial transactions facilitated by the platform rely on the User constituting digital collateral in the form of crypto-assets, intended to secure the loan or financial commitment entered into via wallet.cryptobond.ch.
The User acknowledges that assets transferred as collateral are held within secure storage infrastructure managed by Crypto-Bond AG or its approved custody partners (cold storage protocols, multi-signature architectures, strict segregation of company own funds and client funds).
The User undertakes to use Crypto-Bond AG's websites, portals and services in strict compliance with Swiss law, international law, public order rules, and the rights of third parties.
The User is strictly prohibited from attempting, in any manner, to compromise the proper functioning, integrity or security of Crypto-Bond AG's IT systems (unauthorised intrusion, reverse engineering, decompilation, API misuse, injection of malicious scripts). Massive or automated data extraction (scraping, crawling, data mining) is likewise prohibited without the publisher's express written consent.
Any fraudulent behaviour, suspected money laundering, attempted identity theft, or submission of false documents will result in the immediate termination of the User's account and, where applicable, referral of the file to the competent judicial authorities.
All elements comprising the cryptobond.ch and wallet.cryptobond.ch websites — including graphic design, visuals, text, algorithms, source code structures, logos, trademarks, illustrations, databases and interface elements — are the exclusive, inalienable property of Crypto-Bond AG or are used under a duly granted licence from their rights holders.
Any reproduction, representation, distribution, adaptation, translation, modification or exploitation, in whole or in part, of the website's content, without the prior express written authorisation of Crypto-Bond AG's board of directors, is formally prohibited and constitutes an infringement punishable under Swiss criminal and civil law.
Crypto-Bond AG makes reasonable efforts, in line with industry standards, to ensure continuous, permanent and secure access to its platforms and web services, without assuming any obligation of result regarding uninterrupted availability of the website.
The publisher cannot be held liable for any interruption, malfunction, slowdown or unavailability of the service resulting from a failure of third-party telecommunications networks, a denial-of-service (DDoS) attack, congestion of public blockchain networks, or any event outside its direct control.
Crypto-Bond AG acts exclusively as a publisher of technology platforms and application infrastructure. Under no circumstances does the publisher provide investment advice, financial recommendations, tax expertise, or commercial inducement to carry out financial transactions.
The User is solely responsible for fully assessing their financial situation, their capacity to bear financial risk, and the tax consequences arising from use of the Services. The User is strongly advised to consult independent financial and legal advisors before making any decision.
To the fullest extent permitted by mandatory provisions of applicable Swiss substantive law (in particular Article 100 of the Swiss Code of Obligations — CO), Crypto-Bond AG excludes all liability for direct, indirect, incidental, consequential or punitive damages arising from the use or inability to use its services.
This limitation applies in particular, without limitation, to loss of earnings, loss of profits, data loss, reputational harm, loss of investment opportunities, collateral liquidations caused by market fluctuations, or service interruptions.
The User shall indemnify and hold harmless Crypto-Bond AG, its directors, officers, employees and agents against any claim, demand, judgment, damage, loss or expense arising from the User's breach of these Terms or of a third party's rights.
Crypto-Bond AG attaches fundamental importance to preserving the privacy and protecting the personal data of its Users, in strict compliance with the Swiss Federal Act on Data Protection (nFADP) and the GDPR where applicable. This topic is covered in full in our dedicated Privacy Policy.
In accordance with the nFADP, the User has the right of access, rectification, erasure, restriction of processing and data portability. These rights may be exercised by sending a written request, accompanied by proof of identity, to the Data Protection Officer at: admin@cryptobond.ch.
The cryptobond.ch and wallet.cryptobond.ch websites may contain hyperlinks to websites, applications, decentralised protocols or external resources operated by third parties independent of Crypto-Bond AG. The presence of such links does not, under any circumstances, constitute an endorsement, validation or partnership.
Establishing a deep hyperlink or framing pointing to cryptobond.ch or wallet.cryptobond.ch from a third-party website is strictly prohibited without Crypto-Bond AG's prior express written authorisation.
The agreement governed by these Terms takes effect as soon as the User first accesses or browses the website, and remains in effect for an indefinite period as long as the User uses the Services or maintains an open User Account.
Crypto-Bond AG reserves the right to immediately suspend, restrict or terminate, without notice or compensation, a User's access to all or part of its services in the event of a serious or repeated breach of these Terms, submission of falsified identity documents, legitimate suspicion of money laundering or fraud, or an order from a Swiss judicial or administrative authority.
Crypto-Bond AG reserves the discretionary right to modify, adapt, expand or update this document at any time. Any revised version will be published directly on the website with the date of the last update indicated. Continued browsing or use of the Services after publication constitutes full and unconditional acceptance of the new provisions.
Should any provision of this agreement be declared null, invalid, unenforceable or lapsed, such provision shall be deemed severable without affecting the validity of the other provisions of these Terms.
These Terms are drafted in the French language. Should this document be translated into other languages (including German, English or Italian), only the version drafted in French shall be authoritative and shall prevail in the event of any discrepancy in interpretation or contradiction.
These Terms, their interpretation, performance, validity, and all legal relationships arising from the use of cryptobond.ch and wallet.cryptobond.ch, are exclusively governed by and subject to Swiss substantive law, to the strict exclusion of its conflict-of-law rules and international conventions (including the United Nations Convention on Contracts for the International Sale of Goods — CISG).
